By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

Use of Our Site

You agree to use this Site for lawful purposes only and not to violate any applicable laws or regulations. You may not misuse the Site, attempt unauthorized access, or interfere with its operation.

Products & Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions and pricing at any time without notice.

We have made every effort to display product colors and details accurately; however, we cannot guarantee that your device’s display will reflect the product exactly.

Orders & Payments

By placing an order, you represent that all information provided is accurate and complete and that you are authorized to use the payment method submitted.

We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inaccuracies in pricing or product information, or inventory limitations. If your order is canceled after payment is processed, you will be refunded in full.

Shipping

Shipping timelines provided are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, or events beyond our control.

Risk of loss transfers to you once the order is handed over to the carrier.

Returns & Exchanges

Returns and exchanges are subject to our Returns & Exchanges Policy, which is incorporated into these Terms by reference. Please review that policy before placing an order.

Pre-orders

By placing a pre-order with Be Over There, you agree to the following terms:

    • Pre-Order Commitment: Pre-orders are made to reserve items before they are available for immediate shipping. Because these items are produced in limited quantities, all pre-orders are final and cannot be changed or cancelled after 48 hours of being placed.

    • Estimated Shipping Window: The estimated shipping window provided on the product page at the time of purchase is an estimate only and is subject to change based on production and fulfillment timelines. Orders are still considered valid and active even if they ship up to 2 weeks beyond the estimated date.

    • Delays Beyond 2 Weeks: If your pre-order has not shipped more than 2 weeks after the end of the estimated window, you may contact us to request a cancellation and full refund.

Duties, Taxes & Customs

Where applicable, duties, taxes, and customs fees are included on the original order. All duties, taxes, and customs fees are non-refundable, including on returned or exchanged items.

Intellectual Property

All content on this Site — including text, images, graphics, logos, designs, and trademarks — is the property of Be Over There™ and may not be used, reproduced, or distributed without our prior written consent.

User Content

If you submit content to us (including reviews, photos, or social media tags), you grant Be Over There™ a non-exclusive, royalty-free, worldwide license to use, reproduce, and share that content for marketing and promotional purposes.

Disclaimer of Warranties

Be Over There™ stands behind the quality of our products. We offer a limited lifetime warranty from the date of delivery, covering manufacturing defects in materials and workmanship under normal, intended use.

What’s Covered

  • Defects in stitching, seams, or construction
  • Hardware or closures that fail due to manufacturing defects
  • Fabric defects that appear under normal use

What’s Not Covered

  • Normal wear and tear
  • Damage caused by accidents, misuse, alterations, improper care, or washing contrary to care instructions
  • Damage caused by environmental exposure (rocks, branches, abrasion, extreme conditions)
  • Cosmetic wear, including fading or pilling
  • Fit-related issues or preference-based claims

Warranty Claims

If you believe your item has a defect covered under this warranty, please contact us at contact@beoverthere.com with:

  • Your order number
  • A description of the issue
  • Clear photos of the defect

All warranty claims are reviewed on a case-by-case basis. If approved, we will offer a repair, replacement, or store credit, at our discretion.

Additional Terms

  • This warranty applies only to the original purchaser.
  • Proof of purchase is required.
  • Warranty replacements do not restart or extend the original warranty period.
  • Be Over There™ reserves the right to deny warranty claims that do not meet the above criteria.
  • Covers defects for the reasonable lifetime of the product under normal use.

Limitation of Liability

To the fullest extent permitted by law, Be Over There™ shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of products.

Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Be Over There™ from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Site.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Ontario, Canada, without regard to conflict of law principles.
